hereinafter referred to as "Seller" - and the buyer - hereinafter referred to as "Customer".
1. Scope and general information
Subject to individual agreements and agreements that take precedence over these terms and conditions, the following terms and conditions apply exclusively to the business relationships between the seller and the customer. Unless otherwise agreed, the inclusion of customer's own conditions is excluded. The customer is a consumer, as far as he concludes the contract for purposes which are neither commercial nor professional. On the other hand, a entrepreneur is any natural or legal person or legal partnership, who acts commercial or independent professional in their legal transactions.
2. Conclusion of contract
The contract languages are German or English.
For the customer it is a legally binding purchase offer in relation to the goods contained in the shopping cart, when ordering via the online order form of Karma Art Shop, after entering their personal data and by clicking the button "Buy" in the final step of the ordering process
The essential characteristics of the goods can be found in the respective product description given by the seller. Mistakes of the order can be corrected by clicking on the "Back" button on the browser and then correcting the incorrect entry or using the "Edit" marked links on the order summary before clicking "Buy".
The confirmation of the order takes place by email, directly after sending the order to the email address given by the customer. This automatic receipt confirms that the order has been received by the seller and represents the order acceptance by the seller.
3. Payment
All prices include German VAT of 19%. Only the payment methods shown to the customer during the ordering process will be accepted. Until full payment, the goods remain the property of the seller.
4. Delivery
The delivery is done by sending the goods to the address given by the customer. The expected delivery times can be found in the product description. The packing and shipping costs are specified during the order process.
If goods are delivered with obvious transport damage, the customer is asked to claim these immediately to the deliverer and to contact the seller as soon as possible. The failure to complain or to contact has no consequences for the legal warranty rights of the customer, but helps the seller to make his own claims against the carrier or the transport insurance.
5. Warranty
The warranty that the goods conform to the details given in the product description is based on the german statutory provisions (§§ 434 ff BGB) and lasts 24 months. A guarantee is given by the seller only if it has been explicitly stated in the order confirmation of the respective products. Complaints and warranty claims can be made via the menu item "Contact" or via the other contact options specified there.
6. Storage of the contract text
The text of the contract is stored as long as required by German law. You can view the General Terms and Conditions at any time on www.karma-art-shop.de and save them on your computer. The order data will be sent to the customer by e-mail and are also accessible to registered customers via your customer account.
7. Jurisdiction
The law of the Federal Republic of Germany applies to contracts between the seller and the customer.
If the customer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the seller is the location of the seller.
8. Dispute resolution via the OS platform
The EU Commission provides a platform for out-of-court settlement. This gives consumers the possibility to settle disputes related to the online order out of court in the first instance. The dispute resolution platform can be found here:
EU Commission online dispute resolution platform: https://ec.europa.eu/consumers/odr/
In this case, Karma Art agrees to take part in a dispute resolution procedure before a consumer arbitration board.
